This is my new Logo, I made it from scratch using a computer program what do you guys think? I am in the process of trademarkingand/or copyrighting, The name, logo and motto.

I think the circle is to thick and competes with the text. I like it otherwise.

Like Dennis said, Make the circle narrower, move the text so the text is the same distance from the circle line edge, leave the nib image the same size to allow a small amount of space between the nib and the text.

What program did you use to create the logo??
 
It's beautiful, always love black with gold. I agree with making the circle thinner too. This is just my opinion, I would put the pen nib between the words instead of the letters but again, this is just for me. Beautiful logo and great cause!
 
I'm with the consensus thin the circle, from the inside, leave a bit more room between it and the text, it' looks like a great beginning.
 
Another thing to watch for; the detail on the nib won't reproduce well in black and white or on different scales. A good logo works well in color and black and white and can work in a variety of scales. A good test is to see the logo on your computer screen then scale it down to about the size of a pea or so. If you can't tell what it is, you might keep refining. Think of the Apple Logo or the HP logo with the lowercase letters enclosed in a box. Both are very powerful logos.
 
I like the concept, but I think that the nib is too wide at the bottom and too short for that width.

Can you turn the nib 90 degrees? This will give you the entire circle to use.
I think you will still need to resize.
You may need to reposition the eagle so not sitting sideways.

I will be doing the poor man's way first, Notorizing a copy so if a dispute came up I have evidence that I had it first, in a few months I am going to go ahead with the actual copyright and/or trademark. For most applications notorized copy is sufficient although I wanted to gage the overall apperance prior to doing pulling the trigger on the legal aspects.

AAA LOGO 3.10 it is a free program from the web, it can be a little confusing when you first start I messed around with it for about an hour before I even attempted my logo it has a lot of features and a good portion of them are virtually useless.

I tried it in black and white it seems to maintain the contrast that is given on the black and white in some ways it may have looked better in black and white.
 
I would reduce the line width, change the font and remove the gradients from the type. Then make the nib more proportioned to a real nib. I like the nib scroll work and eagle.
